QUESTION:
What do the scholars of the Dīn and muftīs of the Sacred Law state regarding the following issue: What is the ruling on declaring talaq [divorce] without any problem? What is the method of declaring talaq?
Questioner: Uthman from UK
ANSWER:
بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب
Declaring talaq without any reason is a sin. It is permissible to declare it due to a legal excuse. The soundest way of doing it is to declare it during a period of (the wife’s) purity in which the he (the husband) did not have sexual contact with her. Upon doing so, he must leave her until her ‘iddah (waiting period) is over. This is considered as the best way of declaring talaq. The benefit in this way is that the woman can either marry another man or re-marry the same man once the ‘iddah is over. The husband can even return to her (ruju’) during the ‘iddah. However, if they do not wish to do it then, they can re-marry even after 10-20 years. The husband must see to it that he does not declare three talaqs. If he does so, they will be valid.
